The offer and sale of goods on our Ameliashop.com website are governed by these General Sales Conditions.

The goods purchased on Ameliashop.com are sold directly by Amelia S.p.A. ("AMELIA"). AMELIA is registered in Milan's Trade Register, with number MI1705085, and Income Tax and VAT Registration Number IT03837640964. AMELIA's head office is in Italy, in Via Ansperto 10, 20123 Milan.

Our business policy

1.1

On Ameliashop.com, the Seller offers its goods for sale and carries out its e-commerce business with its own final users only, i.e. with the "consumers".

1.2

 

When talking about "consumers", we are referring to any person accessing Ameliashop.com with no intention of carrying out any commercial, entrepreneurial or professional activity. If you are not such a "consumer", we ask you to refrain from carrying out any commercial transactions using Ameliashop.com

1.3

 

In light of our trade policy, the Seller reserves the right not to follow up on orders received from any person who is not a "consumer" or in any event on orders which do not comply with our business policy.

These General Sales Conditions govern exclusively the offer, the submission and acceptance of purchase orders on Ameliashop.com, between users of Ameliamilano.it and the Seller.

How to enter into a purchase agreement with AMELIA

2.1

In order to enter into a purchase agreement for one or more items on Ameliashop.com, you must fill in the online order form and submit it to the Seller, via e-mail, following the related instructions.

2.2

 

Reference is made to the General Sales Conditions on the order form. There is also a summary of the main characteristics of each item ordered, the relevant price (including all applicable taxes and charges), the payment methods that you may use in order to purchase each item, the delivery methods used for the goods purchased, the shipment and delivery charges, a reference to the conditions for exercising your right to return the goods, and to the methods and timing involved if you need to return any goods purchased.

The agreement is entered into when the Seller receives your order form via e-mail, subject to verification of the correctness of the information provided concerning your order.

2.4

 

Before proceeding to the purchase of the goods by submitting the order form, you will be asked to carefully read the General Sales Conditions and the Informative note on your right of withdrawal, to print them by clicking on the "print" key, and to memorise or save a copy of each for your personal use.

2.5

 

Your order form will be filed in our database for the period of time necessary for dispatch of the order, and, in any event, within the terms of the law. You can access your order form by consulting the section My order.

2.6

 

Before submitting the order form, you will also be asked to identify and correct any errors you may have made when entering your information.

2.7

 

Once the agreement has been entered into, AMELIA will begin processing your purchase order.

2.8

 

The Seller can not carry out your purchase order if no sufficient guarantee of solvency is provided or if the order is incomplete or incorrect, or if the goods are unavailable.

In these cases, we will undertake to inform you by e-mail that the agreement has not been entered into and that the Seller has not carried out your purchase order, explaining the reasons.

If the goods shown on Ameliashop.com are no longer available or not for sale at the moment of your last access to the site, or at the moment of submitting the order form, the Seller will undertake to inform you in good time if any of the goods are unavailable, and in any event within thirty (30) days after the date following the one when you submitted your order to the Seller. If the order form has been sent and a payment made, then the Seller undertakes to refund the amount you have already paid.

Once the order form has been submitted via e-mail, this implies your unconditional acceptance of these General Sales Conditions, and that you undertake to comply with them in your dealings with the Seller. If you disagree with any of the terms in the General Sales Conditions, we ask you not to send the order form for the purchase of goods from Ameliashop.com

2.10

 

Once the order form has been submitted, this implies confirmation that you know and accept the General Sales Conditions as well as any further information contained on Ameliashop.com, including that which is accessed via a link like the General Conditions of Use and the Privacy Policy and the Informative note on the right of withdrawal.

Once the purchase agreement has been entered into, the Seller will send you an e-mail confirming receipt of the purchase order, including a summary of the information already contained on the order form (General Sales Conditions, Informative note on the right of withdrawal, information related to the main characteristics of the goods and a detailed account of the price, methods of payment and delivery costs).

Guarantees and pricing of goods

3.1

Ameliashop.com offers items for sale which are exclusive to the Amelia clothing line, for children from 0 to 8 years of age.

3.2

 

The main characteristics of the items are described on each product card of Ameliashop.com. The pictures and the colours of the goods for sale on Ameliashop.com may however not correspond to the actual colours as a consequence of the Internet browser or the monitor used.

3.3

 

The prices of the goods may be subject to change. Please ascertain the final sales price before submitting the order form.

3.4

 

Purchase requests from countries not listed on the splash page can not be accepted by the Seller.

3.5

 

All goods bear an identifying tag secured with a single-use seal. We ask you not to remove the tag or the attached seal from the goods purchased, as they constitute an integral part of the item.

3.6

 

If you decide to exercise your right of withdrawal, the Seller is entitled not to accept the return of any goods without the attached tag or which have been tampered with in some way, or which have been damaged.

     

4.

 

Payments

4.1

In order to pay for the goods and their related delivery costs, you may use one of the methods shown on the order form.

4.2

 

If you pay by credit card, the financial data (e.g. the credit/debit card number, or the expiry date) will be sent using encrypted protocol, to Banca Sella or to other banks which provide remote electronic payments services, without any third parties having access to such data. Moreover, such data will never be used by the Seller in any way except for the completion of the procedures related to your purchase and for issuing any refund in the event of product returns, if you decide to exercise your right of withdrawal.

Shipment and delivery of the goods

5.1

 

Delivery will be made using the Espresso Courier.
Planned delivery times are: Italy: 1-2 days, Europe: 2-3 days, The rest of the world: 4-5 days.
A note will be left if you are not at home.

Delivery cost in Italy:
from 1 to 3 items :7 Euro
from 4 to 7 items : 10 Euro
from 8 to 10 items : 15 Euro

Delivery cost in Europe:
from 1 to 3 items : 15 Euro
from 4 to 7 items : 20 Euro
from 8 to 10 items : 30 Euro

Delivery cost in the rest of the world:
from 1 to 3 items : 20 Euro
from 4 to 7 items : 25 Euro
from 8 to 10 items : 30 Euro

7.

 

Right of withdrawal

7.1

You have the right to withdraw from the purchase agreement entered into with the Seller, without penalty and without specifying a reason, within ten (10) working days from the date of receipt of the goods bought from Ameliashop.com. You may not however exchange the item chosen for another.

7.2

 

In order to withdraw from the purchase agreement, please contact our Returns Service.

7.3

 

In this event, you must return the goods to the Seller handing them over to the courier for delivery within ten (10) working days from the date on which you received the goods.

7.4

 

The only costs you incur are those for the return of the goods purchased.

7.5

 

The Right of Withdrawal " as well as complying with the terms and methods described in the preceding points 7.1, 7.2, 7.3 and 7.4 " will be considered as having been correctly carried out if the following conditions have also been fully respected:

The goods must not have been used, worn, washed or damaged;

The identifying tag must still be attached to the goods with its single-use seal which is considered as an integral part of the item;

The goods must be returned in their original packaging (if you are returning a kit, you must return all the component parts);

The goods must be returned to the Seller in one single delivery. The Seller, in fact, reserves the right not to accept goods from one single order which have been returned at different times;

Returned goods must be handed over to the courier within ten (10) working days starting from the date on which you received the goods.

7.6

 

If the Right of Withdrawal is adhered to according to the methods and the terms described in this paragraph number 7, the Seller undertakes to refund any amounts already received for the purchase of the goods.

7.7

 

The money will be repaid in the shortest possible time. In any event, within thirty (30) days from the date on which the Seller learned of your wish to carry out your right of withdrawal, we will undertake to activate the refund procedure once the above-mentioned terms and conditions have been correctly carried out, as described in paragraph 8.

7.8

 

If the methods and the terms for carrying out your right of withdrawal have not been complied with, as specified in this paragraph, you will have no right to a refund of any sums already paid to the Seller or to the issue of the credit note requested; nevertheless you may request, at your cost, the return of the goods in the state in which they were returned to the Seller. Otherwise the Seller may keep the goods, in addition to the amounts already paid for their purchase.

Refund methods and timing

8.1

 

After returning the goods, the Seller undertakes to make the necessary checks on the conformity of the same with the terms and conditions described in paragraph 7. If the goods are deemed to comply with these checks, the Seller undertakes to send you an e-mail confirming the acceptance of the goods returned thus.

8.2

 

Whichever method of payment you have used, the refund will be made by the Seller in the shortest possible time and in any event within thirty (30) days from the date on which the Seller learned of your request to carry out your right of withdrawal, subject to verification of the correct execution of your right of request and acceptance of the returned goods.

8.3

 

If the receiver of the goods indicated on the order form does not correspond to the person who made the payment of the amounts due for their purchase, the refund of the money, in the event of exercising the right of withdrawal, will be paid by the Seller to the person who made the payment.

8.4

 

The Seller has chosen Espresso as the courier to be used for the return of goods. If you contact our Returns Service, they will explain all the necessary procedures.

8.5

 

When retuning the goods, if you decide to use a different courier from the one indicated by the Seller and/or use a different procedure, you will be liable for any charges in the event of loss or damage of the goods.

Applicable law and resolution of disputes

11.1

 

The General Sales Conditions are governed by Italian Law, in particular by Legislative Decree no. 206, dated 6 September 2005, regarding consumer law with specific reference to the regulations governing distance contracts and by Legislative Decree no. 70, dated 9 April 2003 on some aspects regarding e-commerce.

11.2

 

In the event of any disputes between the Seller and any final user originating from the General Sales Conditions, the Seller hereby guarantees full compliance with and acceptance of the RisolviOnline conciliation service. RisolviOnline is an independent and institutional service provided by the Chamber of Arbitration of Milan, which allows a satisfactory agreement to be reached online with the help of a neutral and knowledgeable mediator, in an informal and confidential environment. Modifications and updates

12.1

 

The General Conditions of Sale are modified from time to time, also to take into account and regulatory variations. The new General Sales Conditions will take effect from the date that they are published on Ameliashop.com.
